These Terms and Conditions govern your use of the Chosen Home Improvement website and your engagement with our home improvement services. By accessing this website or requesting an estimate, you agree to these terms. Please read them carefully.
1. About Us
Chosen Home Improvement is a licensed roofing contractor operating in MI . Our principal place of business is Saint Clair Shores, MI. You can reach us at (239) 922-7430 or Chosen1gutters@gmail.com.
2. Website Use
This website is provided for informational and lead-generation purposes. You may use it to:
- Learn about our roofing services and service areas
- Request a free estimate or contact our team
- Read our blog articles and project information
You agree not to use this website to:
- Transmit any unlawful, harmful, or fraudulent content
- Attempt to gain unauthorized access to any part of our systems
- Scrape, copy, or reproduce content for commercial use without written permission
- Interfere with the normal operation of the website
3. Estimate Requests
Submitting an estimate request form does not create a contract or obligate either party. A binding agreement for roofing services only exists when both parties have signed a written contract.
Estimates provided verbally or by email are good-faith approximations based on the information available at the time. Final pricing is confirmed in a written proposal after a physical site inspection.
4. Service Agreements
All home improvement services performed by Chosen Home Improvement is governed by a separate written service agreement, which will specify:
- Scope of work, materials, and specifications
- Project pricing, payment schedule, and deposit requirements
- Timeline and scheduling terms
- Warranty terms for materials and craftsmanship
- Change order procedures
In the event of a conflict between these Terms and Conditions and a signed service agreement, the signed service agreement controls.
5. Payments
Payment terms are detailed in each service agreement. Unless otherwise specified in writing:
- A deposit is required before work begins
- Final payment is due upon substantial completion of the work
- We accept check, ACH transfer, and major credit cards
Overdue balances accrue interest at the maximum rate permitted under Florida law. You agree to reimburse us for reasonable collection costs, including attorney fees, if collection action is necessary.
6. Warranties
We warrant our workmanship for the period stated in your service agreement. Manufacturer warranties on materials are separate and are passed through to you directly. Warranty coverage is void if:
- The roof has been modified or repaired by others without our authorization
- Damage results from events outside our control (storm, fallen trees, structural movement)
- Outstanding payment balances remain on the account
Gutter System Limited Labor Warranty
LABOR WARRANTY
This Labor Warranty certifies that the new residential gutters installed by Chosen Home Improvement are guaranteed for a period of two (2) years from date of gutter installation against sagging, pulling loose, leaking or not functioning properly due to improper installation. All claims may be submitted in writing or via email to Chosen Home Improvement.
What is NOT Covered in Labor Warranty:
This Labor Warranty shall not extend to any defect or product failure resulting from: 1) Natural, Act-of-God occurrences such as, but not limited to, lightning, hurricanes, hail, earthquakes, flood, tornadoes, fire, and falling objects; (2) damage to the property or structure to which guttering system has been applied caused by settling, cracking, movement, shifting, distorting, or splitting including but not limited to structural failure of walls, roofs, foundations, fascia, or rafters; (3) inadequate or improper ventilation of the home, or accumulation of water, ice damming or mold due to structural deficiencies and/or insufficient drainage; (4) any deliberate act or negligence of the purchaser, workman, or any other person when installing or maintaining surfaces of structure to which materials have been applied; (5) normal wear and tear as per manufacturer specifications (in case of claim, manufacturing company will have final say if product has to be replaced); (6) color staining, replacement of any rotten wood, water behind gutters without eave metal, or any erosion; (7) any installed materials not provided by Chosen Home Improvement; (8) expansion or contraction of windows, siding, roofing, concrete or trim; (9) improper maintenance of guttering system by customer, including, but not limited to clogging caused by leaves or debris in gutter or cleaning with products that may damage the materials.
The main cause of customer complaints is gutters overflowing due to debris in the gutter. Chosen Home Improvement is not responsible for general maintenance, inspections, and cleaning of guttering systems. Gutter cleanings are not covered by any warranty.
PLEASE NOTE THAT ANY SERVICE CALL REQUESTED AFTER 90 DAYS OF INITIAL INSTALL WILL INCUR A FEE IF WE NEED TO CLEAN GUTTERS TO ACCESS REPAIR OR IF WE FIND THAT THE REPORTED PROBLEM IS DUE TO CUSTOMER NEGLECT OR DUE TO CLOGGING CAUSED BY LEAVES OR DEBRIS. THIS INCLUDES ANY SERVICE CALLS TO REPLACE ROTTED WOOD DUE TO LEAKS FROM NEGLECTING TO CLEAN OR MAINTAIN YOUR GUTTERS.
Rain gutters are not designed to make a watertight seal against the fascia board. Water running between the gutter and fascia board or behind the fascia board is usually caused by one of the following:
- Short, broken or old curled-under shingles causing the water to wick back onto the fascia board.
- Pockets in roof shingles caused by the top of the fascia board being higher than the roof decking, allowing the water to track between the shingles and down behind the fascia board. This may cause rotting of the roof decking, rafter ends, fascia board, or eave overhang.
- Water problems may also be caused by faulty or missing flashing around chimneys, vent stacks, and wall flashing among others.
- Missing or improperly installed drip edge on the roof that results in the bending of the drip edge to properly install the gutter or having to install the gutter on-top of the drip edge.
These cases are not caused by our gutter system and therefore not covered under our Labor Warranty.
Chosen Home Improvement will not be responsible for any peripheral needs or issues related to the guttering system. This includes leaf build-up or clogging, cleaning dirty gutters, issues with drainage or dry-well system, etc. Chosen Home Improvement will not replace a component of the system if it is not faulty while replacing something that is faulty and under warranty. Chosen Home Improvement is also not responsible for another person or contractor's work on the gutter system following our install. This includes but is not limited to a roofer changing the pitch of the roof, the overhang of the shingle or any aspect of the roof as it related to the gutter system at the time of our install.
Installation, removal, repair, adjustment, tampering or re-installation of any Chosen Home Improvement guttering system or component by anyone other than Chosen Home Improvement voids any and all warranties within this document.
The customer has the duty to deliver payment in full based on original signed contract price for material and installation provided by Chosen Home Improvement in accordance with the payment terms set forth; failure to do so voids any and all warranties within this document.
Chosen Home Improvement shall not be liable for injury to persons or damage to property, structure, or contents, or for incidental, special or consequential damages for breach of any written or implied warranty on defects in workmanship. If any warranty work is required that needs to be subcontracted, then Chosen Home Improvement has the right to select the contractor for the warranty work.
In order to make a warranty claim and set up a service call, we require photos and in some cases videos of the area(s) in question.
THIS DOCUMENT IS YOUR WARRANTY AND BECOMES EFFECTIVE UPON RECEIPT OF PAYMENT IN FULL. NO REGISTRATION OR SIGNATURE IS REQUIRED.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Chosen Home Improvement's total liability for any claim arising from our home improvement services or this website is limited to the amount you paid us for the specific work giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, loss of use, or damage to property not directly caused by our negligence.
8. Intellectual Property
All content on this website — including text, photographs, graphics, logos, and page structure — is owned by or licensed to Chosen Home Improvement. You may not reproduce, distribute, or create derivative works from this content without prior written permission.
Project photos shared by customers may be used by us for portfolio and marketing purposes unless you request otherwise in writing before work begins.
9. Third-Party Links
This website may link to third-party websites for your convenience. We have no control over those sites and are not responsible for their content, privacy practices, or terms of use.
10. Dispute Resolution
We prefer to resolve disagreements directly. If you have a concern about our work or billing, contact us first and give us a reasonable opportunity to address it.
Any dispute that cannot be resolved informally will be governed by the laws of the State of Florida, with venue in Macomb County, Florida. Both parties waive the right to a jury trial for any such dispute.
11. Changes to These Terms
We may revise these terms at any time by updating this page. Your continued use of the website after any change constitutes acceptance of the revised terms. We encourage you to check this page periodically.
12. Severability
If any provision of these terms is found unenforceable, the remaining provisions continue in full force and effect.
